2nd Engine Replacement - Lemon?
 
My partner has a 2013 Elantra and she has just been told that the knocking in her engine means she needs a new engine. It's under warranty and covered however, the engine was replaced originally after just 6 months from purchase due to the same knocking defect. So this is the 2nd time they need to replace the engine.

The car was bought new and has only 66,000 kms (41,000 miles) on it. She had a trade-in valued at $2,600 when she purchased the car and bought the extended warranty (140k/7yrs). She financed the car over 7 years, so about halfway through. I believe she still owes about $12,000 on her loan.

So the question is, what are her options, if any? Is it too late to consider this car a lemon and force Hyundai to come up with a compensation offer? Any help would be greatly appreciated.

People really don't understand the Lemon Law. It's not to get a refund just because something breaks. It's if something goes wrong and the manufacturer can't fix the problem after several attempts, then it could be considered a "Lemon".

But as long as the manufacturer is fixing the problem and is honoring the warranty, you can't force them to compensate you.

So, the engine died 4 years ago and they replaced it for free under the warranty. Done deal.

The engine died again 41,000 miles later? As long as Hyundai honors the warranty and replaced the engine, you can't get compensated or sue under Lemon Law.

I'd suggest letting them fix it and then trading it in on another car.
