Default clutch related problem

Hello people,
Im new to the forum and don't know if somebody here has the same issue. I have 2006 model Tucson, diesel crdi with manual transmission in India. The car I got varied a lot from the test drive car in terms of drivability. Always felt as if the clutch was sort of pre-engaging the gears. Say I'm in first gear and moving through slow moving traffic in the city at 10mph, i have to completely depress the clutch and depress the brake atleast 75% to hold it that speed. If I try to take my foot off the brake it would jump forward. Feels more like the car needs to be 'de-tuned' !!
I bought the car from a dealer friend brand new, and when I complained he was always 'sure' nothing was wrong. Later when I took it to a dealer in another city, they believed the clutch was faulty and replaced it for free since the car had low miles(after warranty period). The car was good for a month, and its back to its old habits again. I just feel annoyed when I drive it. Does anybody have a similar experience or know what could be the problem ? I need to know what the problem can be before I take it to dealer, don't want to get ripped off having to replace unneccessary mechanicals..
